- swimming ability, experience level, equipment requirements or other safety-related information;

Health and other sensitive personal information will be collected only where it is reasonably necessary and with written or other legally valid consent, unless processing is otherwise permitted or required by law or is necessary to protect a person’s vital interests.
Website and device information
When you use our websites, our website platform and authorised service providers may automatically receive:
- Internet Protocol address;

- approximate location derived from an IP address;
- pages viewed, links selected, referring page and date and time of access;

- diagnostic, security and performance information.
Images and media
We may capture photographs, video or audio during an experience. We will seek separate consent before using an identifiable person’s image for promotional or marketing purposes where consent is required. Refusing promotional media consent will not prevent you from receiving the booked service.
3. How we collect personal information
We collect personal information:
- directly from you when you complete a form, communicate with us, make a booking, pay, register, sign a waiver or participate in an experience;
- from a person organising or paying for a group booking;

If you provide personal information about another person, you must be authorised to do so and must make this Privacy Policy available to that person. Each adult participant may still be required to provide and approve their own safety information, waiver and consent.
4. Why we use personal information

Where applicable, we rely on one or more of the following grounds:
- your consent;
- steps requested by you before entering into a contract;

- protection of your or another person’s vital interests;
- our legitimate interests or those of a third party, where those interests are not overridden by your rights and freedoms; or
- another ground permitted by applicable law.
You may withdraw consent at any time by contacting us. Withdrawal does not affect processing that occurred lawfully before consent was withdrawn. If particular information is necessary for safety, a legal requirement or performance of a booking, withdrawing or withholding it may mean that we cannot safely or lawfully provide the relevant service.
5. Marketing communications
We may send news, offers and information about Far and Wide experiences if you have asked to receive them or if applicable law otherwise permits us to do so.
You may opt out at any time by:
- using the unsubscribe option in a marketing message;
- replying with an unsubscribe request; or
- emailing reservations@farandwideafrica.com.
Opting out of marketing will not stop booking confirmations, safety messages, payment notices or other communications necessary to provide a requested service.
We do not sell or rent personal information to third parties for their own marketing.
6. Cookies and similar technologies
Our websites may use:
- **essential cookies**, which are required for website operation, security, navigation and form submission;
- **preference cookies**, which remember choices or settings;
- **analytics cookies**, which help us understand website use and improve performance; and
- **functional or media cookies**, which support features such as video, maps, social-media links or embedded content.
Where required, non-essential cookies will be used only after you have made a choice through the website’s cookie controls. You can also restrict or delete cookies through your browser. Blocking some cookies may affect website functions.
Third-party content or links may allow the relevant provider to collect information under its own privacy policy. This Privacy Policy does not control independent third-party websites.

8. International transfers
Far and Wide operates in more than one country, serves international travellers and uses technology and travel-service providers that may process or store information outside Zimbabwe.
Where personal information is transferred outside Zimbabwe, we will take reasonable steps to comply with applicable cross-border transfer requirements. Depending on the circumstances, this may include:

We use reasonable technical and organisational measures designed to protect personal information against accidental or unlawful loss, destruction, alteration, unauthorised access, use or disclosure. Measures may include access controls, staff confidentiality obligations, secure service providers, backups, system updates and procedures for handling security incidents.
No website, email, messaging or storage system can be guaranteed to be completely secure. Please avoid sending unnecessary sensitive information through ordinary email, social media or unsecured messaging.
If a personal-data breach occurs, we will investigate it, take reasonable steps to contain and remedy it, and notify the Data Protection Authority or affected individuals where required by applicable law.
10. How long we keep information
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including to:
- provide the requested service;
- maintain booking, financial, tax and insurance records;
- respond to complaints, incidents and legal claims;

- establish, exercise or defend legal rights.
Retention periods vary according to the type of information and legal requirements. When information is no longer required, we will securely delete or anonymise it where reasonably practicable.
Unsuccessful enquiries and routine correspondence will generally be kept for a shorter period than confirmed booking, transaction, incident or legal records. Sensitive health and safety information will not be retained longer than reasonably necessary unless continued retention is required or permitted by law.
11. Children
Our websites are not intended to collect personal information directly from children without appropriate adult involvement.
Where a participant is under 18, we may collect information from and communicate with a parent or lawful guardian. A parent or guardian must provide any consent required for the child’s booking, safety information, participation and optional promotional media use.
We will handle a child’s information with particular care and limit it to what is reasonably necessary for the service, safety and legal requirements.

Subject to applicable law and any lawful exceptions, you may ask us to:
- confirm whether we process your personal information;
- provide access to your personal information and information about its processing;
- correct information that is inaccurate or incomplete;
- delete, block or restrict information that should no longer be processed;
- object to particular processing, including direct marketing;

You may also lodge a complaint with the **Postal and Telecommunications Regulatory Authority of Zimbabwe (POTRAZ)** in its capacity as the Data Protection Authority.
To exercise a right, contact reservations@farandwideafrica.com with the subject line **“Privacy Request.”** We may request reasonable proof of identity or authority before disclosing or changing personal information. We will respond within the period required by applicable law.
Some rights are not absolute. We may retain or continue processing information where required or permitted for contractual, safety, public-interest, legal-compliance or legal-claim purposes. If we cannot fulfil a request, we will provide an explanation where required.
13. Third-party websites and services
Our websites may link to websites, booking platforms, social networks, maps or services operated by independent third parties. Their privacy policies and practices apply when you use those services. We are not responsible for an independent third party’s website or privacy practices merely because we provide a link to it.
14. Changes to this Privacy Policy
We may update this Privacy Policy when our services, technology or legal obligations change. The revised version will be posted on our website with a new effective date. Material changes may also be communicated through another appropriate channel.
15. Contact and complaints

A Legal Disclaimer
IMPORTANT — PLEASE READ CAREFULLY**
This is a legally binding agreement. Adventure travel and outdoor activities can cause serious injury, illness, permanent disability, death, or loss of or damage to property.
By separately accepting this agreement, you confirm that you understand the disclosed risks, voluntarily assume the inherent and reasonably foreseeable risks of the activities you choose to undertake, and agree to the release, limitation of liability and indemnity below, to the fullest extent permitted by applicable law.
This agreement does not exclude or limit liability that cannot lawfully be excluded or limited, including liability arising from fraud, wilful misconduct, recklessness, gross negligence, or any non-excludable statutory duty.
1. Who we are
In this agreement:
-**“Far and Wide”**, **“we”**, **“us”** and **“our”** mean Far and Wide Zimbabwe (Private) Limited and Mutarazi Sky Walk and ZipLine (Private) Limited, including services promoted under the Far and Wide Africa brand, together with the particular Far and Wide entity identified in your quotation, booking confirmation or activity registration.
- **“Protected Parties”** means those entities and, where applicable, their parent, subsidiary and affiliated entities; property owners and occupiers; directors; officers; employees; guides; instructors; race officials; medical personnel; volunteers; agents; representatives; sponsors; partners; insurers; and independent contractors.
- **“Participant”**, **“you”** and **“your”** mean each person who stays at our accommodation, enters our premises, travels with us, attends an event, or participates in an Activity.
- **“Activities”** include all accommodation, transport, tours, excursions, events and recreational or adventure activities provided, arranged or promoted by Far and Wide, including SkyRun Zimbabwe, the Turaco Trail, hiking, trail running and ultra-marathons; guided or self-guided walks; camping; ropes and high-ropes courses; obstacle and team-building courses; the Mutarazi Falls SkyWalk and Skyline/zipline; white-water rafting and other river or water activities; cycling; wildlife, birding and nature experiences; transfers; and any related training, briefing, equipment use or presence at associated premises.
The exact registered names, company numbers, trading names and physical addresses of all contracting entities must appear in the final published version of this agreement.
Far and Wide enters into the protections in this agreement for itself and for the benefit of each Protected Party. To the extent permitted by law, each Protected Party may rely on and enforce the provisions intended for its benefit.
2. Application and acceptance
Our general booking terms apply when a booking is confirmed by accepting a quotation, paying a deposit or balance, submitting an entry, checking an acceptance box, signing a booking form, or using the booked services after having been given a reasonable opportunity to read those terms.
This risk waiver requires the Participant’s own clear and separate acceptance before participation in an Activity. Each adult Participant must accept it individually. A person making a group booking may accept commercial booking terms and provide information for the group, but may not waive another adult’s legal rights unless legally authorised to do so.
A parent or lawful guardian must complete the minor section for every Participant under 18. Acceptance for a minor is effective only to the extent permitted by law.
3. Website and information disclaimer
We take reasonable care to keep our website, quotations, itineraries, maps, route descriptions, photographs, availability and other information accurate. Conditions in remote and natural areas can change quickly, however. Images may be illustrative; wildlife sightings, views, weather, water levels, route conditions, journey times, internet access, electricity, amenities and uninterrupted availability are not guaranteed.
Information on our website is general information and is not medical, legal, safety or travel advice. Participants remain responsible for obtaining current professional advice and official information relevant to their health, fitness, travel documents, visas, vaccinations, medication, insurance and destination.
To the fullest extent permitted by law, we are not liable for reliance on information that has become inaccurate due to events beyond our reasonable control. Nothing in this section excludes our responsibility for a material misrepresentation made by us or any other liability that cannot lawfully be excluded.
Links to third-party websites are provided for convenience. We do not control and are not responsible for their content, security, availability or privacy practices.
4. Acknowledgement of adventure and remote-area risks
I understand that the Activities may take place in remote, mountainous, forested, wilderness, river or wildlife areas where roads, communications, rescue services, medical care, infrastructure and safety standards may be limited or different from those in my home country. Assistance and evacuation may be delayed by distance, terrain, darkness, weather, water levels, aircraft availability, communications failure or other circumstances.
I understand that risks include, without limitation:
- slips, trips and falls; falling from height; falling objects; collisions; entrapment; drowning; near-drowning; rope burn; cuts; sprains; fractures; head, neck or spinal injury; permanent disability; and death;
- uneven, loose, wet, steep, exposed or unstable terrain; cliffs, bridges, platforms, ladders, trails, roads, river crossings and unguarded natural features;
- fast, cold or deep water; rapids; currents; submerged objects; changing river levels; capsizing; and waterborne disease;
- strenuous exertion, fatigue, dehydration, heat or cold stress, hypothermia, altitude effects, cardiac events and the aggravation of an existing or unknown medical condition;
- rain, lightning, wind, mist, flood, fire, falling trees, rockfall, landslide, poor visibility, extreme temperatures and other natural hazards;
- wild or domestic animals, birds, reptiles, insects, ticks and plants, including bites, stings, allergic reactions, disease and unpredictable animal behaviour;
- vehicles, transfers, public roads, poor road surfaces, mechanical breakdown, driver error and the acts of other road users;
- equipment failure or misuse; harness or protective-equipment discomfort; and risks arising when instructions are misunderstood or not followed;
- food allergies, contamination, communicable illness and limited access to special diets or medication;
- theft, loss of or damage to luggage, vehicles, devices or other personal property;
- the acts or omissions of other Participants, spectators, landowners, independent suppliers and members of the public; and
- changes, delays, cancellation or interruption caused by weather, safety concerns, government action, civil disturbance, labour action, disease outbreak, transport disruption, supplier failure or another event beyond reasonable control.
This list is not exhaustive. Unknown and unexpected risks may also arise.
5. Voluntary assumption of risk
I confirm that I have had the opportunity to ask questions, that I understand the nature and demands of my selected Activities, and that I voluntarily choose to participate.
I knowingly accept and assume all inherent and reasonably foreseeable risks of the Activities, including the risk of serious injury, illness, permanent disability, death and property loss, whether the Activity is guided or self-guided and whether the risk is specifically listed in this agreement or not.
I understand that guides, briefings, inspections, safety systems and protective equipment can reduce risk but cannot eliminate it.
6. Health, fitness and disclosure
I confirm that I am physically and mentally capable of participating safely in my selected Activities, or that I have obtained appropriate medical advice before participating.
I will privately disclose to an authorised Far and Wide representative any condition, medication, allergy, pregnancy, recent surgery, injury, disability, severe fear of heights, swimming limitation or other information reasonably relevant to my safe participation. I understand that disclosure does not transfer responsibility for my health to Far and Wide and does not guarantee that participation will be approved.
I will not participate while impaired by alcohol, illegal drugs, medication, fatigue, illness or any other condition that may endanger me or another person.
Far and Wide may, acting reasonably, refuse, suspend or end my participation where my health, conduct, equipment, ability or failure to follow instructions creates a safety risk. Safety decisions are final. Any refund will be determined under the applicable booking terms and the circumstances of the decision.
7. Participant responsibilities
I agree to:
- attend required briefings and honestly answer safety-screening questions;
- follow all lawful and reasonable instructions, signs, route markings, age, height, weight, equipment and supervision requirements;
- use required safety equipment correctly and not interfere with safety systems;
- wear suitable footwear and clothing and carry any mandatory kit, medication, water and food;
- remain within designated areas and not approach, feed or disturb wildlife;
- act responsibly and avoid endangering myself, staff, other Participants, the public, property or the environment;
- promptly report hazards, accidents, symptoms, damaged equipment or unsafe conduct; and
- comply with applicable laws, park rules, event rules and third-party supplier conditions.
I am responsible for checking any activity-specific restrictions. Published limits are safety requirements, not guarantees that an Activity is suitable for every person within those limits.
8. Emergency care, rescue and evacuation
If I am unable to provide informed consent during an emergency, I authorise Far and Wide and its representatives to arrange first aid, medical treatment, rescue, evacuation, transport or repatriation that they reasonably consider necessary. This authority does not create a duty to provide medical care beyond any duty imposed by law, nor does it guarantee the availability or outcome of rescue or treatment.
I accept responsibility for the reasonable costs of treatment, medication, search, rescue, evacuation, transport and repatriation incurred for me, except to the extent that such costs arise from liability that Far and Wide cannot lawfully exclude or are covered and paid by Far and Wide or another provider.
9. Mandatory insurance
Unless Far and Wide expressly confirms otherwise in writing, every Participant must hold comprehensive travel and medical insurance valid for the destination and the specific Activities. Cover should include, as applicable, emergency treatment, high-risk or adventure activities, search and rescue, air and ground evacuation, repatriation, trip cancellation and curtailment, personal liability, and loss of or damage to property.
I am responsible for checking exclusions, limits and pre-authorisation requirements and for carrying proof of cover and emergency contact details. Any assistance or evacuation arrangement offered by Far and Wide is not a substitute for my own insurance.
10. Independent suppliers
Some accommodation, transport, guiding, permits, meals and Activities may be supplied by independent third parties. Their services may be subject to their own terms and to local laws, tariffs and international conventions.
Where Far and Wide acts only as a booking agent or intermediary, the independent supplier remains responsible for performing its service. To the fullest extent permitted by law, Far and Wide is not liable for an independent supplier’s acts or omissions that Far and Wide could not reasonably have prevented, but this does not exclude liability for Far and Wide’s own breach of a non-excludable duty, negligent selection where legally established, fraud, wilful misconduct, recklessness or gross negligence.
11. Release, waiver and limitation of liability
In consideration of being permitted to participate, and **to the fullest extent permitted by law**, I:
1. release and discharge the Protected Parties from claims arising from the inherent and reasonably foreseeable risks that I have voluntarily assumed;
2. waive claims for loss, damage, injury, illness or death arising from my own acts or omissions, my breach of this agreement or the rules, the ordinary risks of wilderness and adventure activities, or events beyond the Protected Parties’ reasonable control; and
3. where applicable law permits, release the Protected Parties from claims arising from ordinary negligence connected with the Activities.
This release does **not** apply to fraud, wilful misconduct, recklessness, gross negligence, breach of a non-excludable statutory duty, or any other liability that cannot lawfully be excluded or limited.
To the fullest extent permitted by law, the Protected Parties are not liable for indirect, special or consequential loss, loss of enjoyment, missed connections, loss of income or business opportunity, except where such exclusion is prohibited by law.
Nothing in this agreement removes any right or remedy granted to a consumer by the Consumer Protection Act [Chapter 14:44] or other applicable law where that right or remedy cannot lawfully be waived.
12. Indemnity
To the fullest extent permitted by law, I indemnify and hold harmless the Protected Parties against third-party claims, losses, liabilities and reasonable legal costs to the extent caused by:
- my negligent, reckless, unlawful or intentional act or omission;
- my breach of this agreement, an activity rule or a lawful and reasonable instruction;
- damage I cause to property or injury I cause to another person; or
- materially false or withheld information supplied by me where the information was reasonably requested for safety or booking purposes.
This indemnity is proportionate to my responsibility and does not require me to indemnify a Protected Party for that party’s fraud, wilful misconduct, recklessness, gross negligence, or liability that cannot lawfully be transferred or excluded.
13. Personal property
I remain responsible for my money, documents, vehicle, luggage and valuables. Any storage or assistance is provided subject to reasonable care and any written facility rules. We are not responsible for ordinary wear, unattended property or loss outside our reasonable control, but nothing in this section excludes liability that cannot lawfully be excluded.
14. Changes, delays and force majeure
Far and Wide may make reasonable changes to routes, schedules, accommodation, transport, guides or Activities where necessary for safety, weather, operational requirements, supplier availability or events beyond reasonable control. We may cancel or suspend an Activity where continuing would be unsafe or unlawful.
Refunds, credits and additional costs will be handled under the applicable booking and cancellation terms and any non-excludable consumer rights. Far and Wide is not responsible for failure or delay caused by circumstances beyond its reasonable control, but will take reasonable steps to communicate material changes and reduce avoidable disruption.
### 15. Complaints and incidents
Safety concerns, incidents and service complaints should be reported promptly to the guide, manager or Far and Wide contact so that assistance can be provided and the matter can be investigated. If a complaint is not resolved during the trip, it should be submitted in writing to [legal/customer-care email] as soon as reasonably practicable, with the booking reference and supporting information.
Nothing in this section prevents a Participant from exercising a non-excludable statutory right or approaching a regulator or court with jurisdiction.
16. Privacy and health information
Far and Wide may collect and use identity, contact, booking, emergency, insurance and relevant health information to administer bookings, assess participation, manage safety, respond to emergencies, meet legal obligations and handle claims. Sensitive information will be shared only where reasonably necessary with authorised staff, guides, medical providers, insurers, emergency services, suppliers or authorities, subject to applicable data-protection law and our Privacy Notice.
17. Optional photography and media consent
Media consent is optional and is not a condition of receiving the service.
**Choose one:**
- [ ] **YES.** I grant Far and Wide and its affiliated brands a worldwide, royalty-free, non-exclusive licence to use identifiable photographs, video and audio of me captured during the experience for genuine editorial, promotional and marketing purposes, in any media. I understand that material already lawfully published or incorporated into completed materials may not be fully retractable.
- [ ] **NO.** I do not consent to identifiable promotional use of my image. I understand that I may appear incidentally in crowd or background footage where it is not reasonably practicable to exclude me.
Consent may be withdrawn for future use by contacting [privacy email]. A parent or lawful guardian must decide for a minor.
18. Minors
As parent or lawful guardian of the minor named below, I:
- consent to the minor’s participation in the specified Activities;
- confirm that I have explained the Activities and rules to the minor in an age-appropriate way;
- confirm that I have disclosed information reasonably relevant to the minor’s safety;
- authorise emergency care for the minor on the terms above; and
- personally agree to the responsibilities and indemnity in this agreement, but only to the extent permitted by law.
Nothing in this agreement purports to waive a minor’s rights where the law does not permit a parent or guardian to do so.
19. Governing law and jurisdiction
This agreement and any non-contractual obligations connected with it are governed by the laws of Zimbabwe.
Subject to any non-excludable consumer right to use another forum, the courts of Zimbabwe have jurisdiction. The parties may first attempt in good faith to resolve a dispute through direct discussion or mediation, but urgent relief and statutory complaint rights remain available.
20. General
If any provision is found unlawful or unenforceable, it will be limited or severed only to the minimum extent necessary, and the remaining provisions will continue in effect.
No failure or delay in enforcing a provision is a waiver. No staff member may vary this agreement orally. A variation must be recorded in writing by an authorised Far and Wide representative.
This agreement operates together with the applicable quotation, booking terms, cancellation policy, Privacy Notice, activity rules and supplier terms. If there is a conflict, mandatory law prevails, followed by any specifically agreed written term for the booking.
Electronic acceptance and electronic signatures may be used and retained as evidence to the extent permitted by law.
Participant declaration
By signing or actively checking the acceptance box below, I confirm that:
- I have read this entire agreement and had a reasonable opportunity to ask questions;
- I understand that it affects my legal rights and remedies;
- I understand and voluntarily accept the disclosed risks;
- the information I have provided is accurate and complete; and
- I accept this agreement freely and without pressure.
